US Supreme Court Turns Down Virginia’s Fast Track Appeal on Obamacare

We all knew it was a long shot, and Virginia Attorney General Ken Cuccinelli had to try.

I spoke with Cuccinelli at the Tax Day TEA Party rally before he went onstage about the chances. He was glad the court had not killed the appeal at the first look, but was not extremely confident of the final decision. He said they were asking for an exception, and the Supreme Court is very stingy with such exceptions. Cuccinelli would not predict the outcome, but said it was a long shot.

And in the grand scheme of things, not granting an exception here was probably the right move for SCOTUS.

An exception would lower the bar for future cases of great importance to skip lower courts altogether and get a final ruling directly from the top of the Judicial food chain. Probably not a great idea.

Also, the finding of the lower court would also give the Supreme Court a bit of cover. Not that they need any cover, but should the appeal to be heard next month be decided in favor of Virginia, the subsequent appeal to SCOTUS would be less explosive, perhaps, should Justice Kennedy decide to join the 4 conservative members and vote the mandate unconstitutional. The left will still spin their heads, but those in the middle would see Obamacare go down in three courts.

On the other hand, if the case next month is decided in favor of the US, it is a tie, and Kennedy is free to justify his opinion on either side.

In either case, and no matter how the Supreme Court decides, Obamacare will go down. Repeal will happen as soon as enough Progressives are purged from Washington. And that is in the cards.

Or Obamacare will simply implode into itself with skyrocketing costs and unaffordable coverage that taxpayers, already on the hook for the most wasteful spending of any administration in history, will be up to our necks in debt interest and payments to even provide the basic constitutional requirements of government.

As the truth unfolds, costs rise and the Obamacare exemptions continue to be handed out to Obama’s friends, the people understand that this is something we simply cannot afford.

And Obama lied about cost savings.

And the poll numbers show Americans don’t want this expensive nightmare. Just one more reason to turn the Senate and White House over to those who promise to repeal Obamacare in 2012.
